In this privacy policy, we explain which personal data we process in connection with our website www.dream-plan-teach.ch and our online shop, for what purposes we do so, to whom we disclose data and what rights you have. It is based on the Swiss Federal Act on Data Protection (FADP/DSG) and takes into account the EU General Data Protection Regulation (GDPR/DSGVO) where it applies.
1. Controller
The controller responsible for the data processing described in this privacy policy is:
dream. plan. teach.
Simple partnership of Mauro Stehle and Livia Stehle
Im Feld 13c
5712 Beinwil am See
Switzerland
E-mail: hallo@dream-plan-teach.ch
For questions about data protection and to exercise your rights, you can reach us at hallo@dream-plan-teach.ch. The contact person for data protection enquiries is Mauro Stehle.
2. What data we process
We process in particular the following categories of personal data:
- Contact and order data: name, e-mail address, billing and delivery address, products ordered, prices, time and status of the order;
- Content of your planner: information you enter in the configurator, e.g. the title and subtitle of the cover, timetable, holidays and public holidays, uploaded PDF pages and your voluntary answer to the question of how you heard about us;
- Payment data: chosen payment method, payment status and transaction references. We do not receive full card or account details; these are processed by our payment service provider (section 5);
- Communication data: the content of your messages to us and information about e-mails we send you (recipient, subject, content, delivery status);
- Information on schools and bulk orders: name and address of the school, name, e-mail address and telephone number of the contact person, and name and e-mail address of the participating teachers;
- Technical and usage data: IP address, browser and device information, pages visited, time of access, previously visited website and your interactions with our website (sections 10 to 12).
We receive most of this data directly from you. We receive the payment status from our payment service provider, and the shipping status and tracking number from our printing partner.
Please only enter information in your planner that you need for it. You may only enter personal data of third parties, e.g. of pupils, if you are entitled to do so. Sensitive personal data, such as health information, does not belong in the planner.
3. Purposes of processing
- Processing orders: production and shipping of your planner, delivery of digital products and vouchers, payment processing, invoicing, cancellations and complaints;
- Communication: answering enquiries, order and shipping confirmations, customer service;
- Bulk orders: registration of schools, assignment of teachers’ orders and invoicing;
- Marketing: newsletter, information about our own similar products for customers and requests for a review (section 7);
- Operation, security and improvement of the website: providing the website, error analysis, protection against misuse, statistical analysis and further development of our offering;
- Compliance with legal obligations, in particular retention obligations, and the enforcement or defence of claims.
4. Basis for processing
We process personal data in accordance with the principles of the FADP (Art. 6 DSG). Where a justification is required, we rely on the performance of the contract with you, on our overriding legitimate interests, on legal obligations or on your consent (Art. 31 DSG). Our legitimate interests lie in particular in a secure and user-friendly website, in the further development of our offering and in informing our customers about similar products.
Where the GDPR applies, we rely on Art. 6(1)(b) GDPR (contract and pre-contractual measures), (c) (legal obligation), (f) (legitimate interests) and (a) (consent).
You can withdraw your consent at any time with effect for the future, e.g. via the unsubscribe link in the newsletter or by e-mail to hallo@dream-plan-teach.ch.
5. Order and payment
To process an order, we need the information entered during the ordering process and the content of your planner. Without this information, we cannot fulfil the order. Your cart is linked to your browser via a technically necessary cookie (section 11). Carts that are not completed expire after 30 days and can no longer be used after that.
We use Stripe for payment processing (Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland). Payment is made in a payment form provided by Stripe that is embedded in our website or, for vouchers, on a Stripe payment page. Stripe receives your name, your e-mail address, your billing address, the products ordered and the amount, as well as the payment details you enter directly with Stripe. Stripe creates a customer profile for you, issues the payment receipt or invoice and uses its own cookies and similar technologies to prevent fraud. Stripe also processes some data in the USA (section 13). Further information: stripe.com/ch/privacy
If you choose TWINT, Apple Pay or Google Pay, the respective provider additionally processes your payment data in accordance with its own privacy policy.
6. Production and shipping
Printed planners are produced and shipped by our printing partner Bubu. For this purpose, we send them your name, your e-mail address, the delivery address, the products ordered and the print files of your planner. The printing partner hands the parcel over to Swiss Post and reports the shipping status and tracking number back to us.
We send digital planners and vouchers to you as a PDF file by e-mail. We delete the print and PDF files stored in our system two months after they were created.
7. E-mails, newsletter and review requests
7.1 E-mails about your order
We send you the e-mails needed to process your order, e.g. the order confirmation, the shipping confirmation with tracking number and notifications about cancellations, complaints and bulk orders. To send them, we use Brevo (Sendinblue SAS, 106 boulevard Haussmann, 75008 Paris, France) and our e-mail hosting provider. We log e-mails sent (recipient, subject, content, delivery status) so that we can trace their delivery and answer queries. We are also notified of every order by e-mail to our own mailbox; this e-mail contains the order details and the print files.
7.2 Newsletter
If you sign up for our newsletter, we store your e-mail address with Brevo in order to send you the newsletter. Brevo can record whether an e-mail was opened and whether links in it were clicked; this helps us to improve our content. You can unsubscribe from the newsletter at any time via the unsubscribe link in every issue.
7.3 Information for customers
If you buy something from us, we add your e-mail address to a customer list at Brevo. We may then occasionally send you information about our own similar products, e.g. the planner for the next school year. We point this out to you when you place your order. You can object to this at any time by e-mail to hallo@dream-plan-teach.ch or via the unsubscribe link in every such e-mail (Art. 3(1)(o) of the Swiss Federal Act against Unfair Competition, UWG).
7.4 Review request
A few days after your order (around ten days for printed planners, around five days for digital products), we send you a single e-mail asking you to review us on Google. If you follow the link, Google processes your data in accordance with its own terms. We send this e-mail only once and without a reminder.
8. Contact form and enquiries by e-mail
If you write to us via the contact form or by e-mail, we process your name, your e-mail address and the content of your message in order to answer your enquiry. Messages from the contact form are delivered to us by e-mail. To protect against spam, we use a form field that is invisible to humans; no external captcha service is used.
9. Schools and bulk orders
If a school registers for bulk orders, we process the information about the school and the contact person in order to review the registration and process the bulk order. If teachers order as part of a bulk order, we process their name, their e-mail address and the content of their planner. We pass the teacher’s name and e-mail address as well as information about their order on to the school’s contact person. Signing up for the newsletter is voluntary (section 7.2).
10. Web analytics and error analysis
10.1 PostHog
We use PostHog, a service of PostHog Inc., 2261 Market Street #4008, San Francisco, CA 94114, USA. We use the EU version of PostHog; the data is stored on servers in the EU (Frankfurt, Germany). The data is transmitted to PostHog via our own domain. The purpose is to understand how our website is used, to detect errors and to improve the website and the ordering process. PostHog records:
- pages visited, clicks and other interactions, scroll and click positions (heatmaps) and loading times;
- recordings of visits (session replay): the course of your visit with mouse movements, clicks and displayed page content. Entries in form fields are masked and not recorded; the Stripe payment form is not recorded;
- technical error messages and console messages from your browser;
- your IP address and the approximate location derived from it, browser, operating system, device type, screen size, the previously visited website and campaign parameters in links.
To recognise returning visits, PostHog stores a randomly generated, pseudonymous identifier in your browser’s local storage; PostHog does not set cookies on our website. If local storage is blocked, the identifier applies only to the current visit. When you submit a form (order, voucher, contact, school registration), we link this identifier to a hash value (SHA-256) of your e-mail address. This allows us to analyse visits on different devices together with your order. We do not transmit your e-mail address itself to PostHog; the hash value is, however, pseudonymised personal data.
In addition, we store our server log data (section 12) with PostHog; when e-mails are sent, this also includes the recipient address. PostHog deletes recordings of visits after 30 days; we retain the remaining data for as long as we need it for the purposes stated. Access by PostHog Inc. from the USA is possible (section 13). Further information: posthog.com/privacy
10.2 Plausible Analytics
For simple visitor statistics, we additionally use a self-hosted instance of Plausible Analytics on servers of our IT service provider. Plausible does not set cookies and does not store an identifier in your browser. Your IP address and browser information are only used to generate a count value that changes daily and are not stored. For certain events, e.g. a completed purchase, our server transmits your IP address and browser information to Plausible for the same purpose. Plausible only stores aggregated statistics.
10.3 Objection
You can object to web analytics at any time. With the following switch, you deactivate PostHog (including the recording of visits) in this browser; we then also do not transmit any analytics data when you buy a voucher. Plausible does not store any personal data (section 10.2) and therefore continues to count anonymously. We store your objection in your browser’s local storage (section 11). It applies until you delete the website data and must be declared separately in each browser and on each device. We need the server logs (section 12) for operation and security; they are not covered by this objection.
Web analytics with PostHog is active in this browser.
You can also let us know by e-mail to hallo@dream-plan-teach.ch that we should delete the analytics data linked to your e-mail address.
11. Cookies and local storage
We do not use advertising cookies or third-party cookies for advertising purposes. The following cookies and entries in your browser’s local storage are used on our website:
- dpt_cart_session (cookie, technically necessary): links your cart to your browser; signed and not readable by scripts; lifetime up to 30 days;
- dpt_has_cart (cookie, technically necessary): indicates whether a cart exists; lifetime up to 30 days;
- NEXT_LOCALE (cookie, technically necessary): stores your language choice;
- ph_…_posthog (local storage and session storage): pseudonymous identifier from PostHog (section 10.1); remains stored until you delete the website data;
- dpt_analytics_opt_out (local storage, only after your objection): stores your objection to web analytics (section 10.3); remains stored until you delete the website data;
- other technical entries in local storage and session storage, e.g. for your colour selection, for passing data between the steps of the ordering process and to prevent a purchase from being counted twice;
- Stripe cookies in the payment form for fraud prevention (section 5).
You can delete or block cookies and website data in your browser at any time and thereby refuse this processing. Without the technically necessary cookies, however, you cannot place an order.
12. Hosting, server logs and security
Our website and our database are operated by hosting providers in Switzerland and the EU. Each time our website is accessed, our servers log your IP address, date and time, the address accessed, the status code and information about your browser; when e-mails are sent, we also log the recipient address. We need these logs for the operation, error analysis and security of our website and retain them only for as long as necessary for these purposes. To protect against misuse, e.g. mass registrations, we also temporarily keep IP addresses in memory, not in a database, in order to limit the number of requests.
We protect your data with appropriate technical and organisational measures. The transmission between your browser and our website is encrypted (TLS). Only persons who need access to personal data for their tasks have it; we store passwords for the administration only as a hash value. We do not store full payment data.
13. Recipients and disclosure abroad
We only pass on personal data to the extent necessary for the purposes stated. Recipients are in particular:
- IT, hosting and e-mail service providers (Switzerland and EU);
- Brevo for e-mails and newsletters (France);
- Stripe for payments (Ireland and USA);
- depending on the payment method chosen, TWINT (Switzerland), Apple or Google (including USA);
- PostHog for web and error analysis (EU, access from the USA possible);
- our printing partner Bubu and Swiss Post for production and shipping;
- for bulk orders, the contact person of the respective school;
- where necessary, fiduciary and consulting firms as well as authorities, if we are legally obliged to do so.
Personal data is therefore also transferred to states of the EU or EEA and to the USA. According to the Swiss Federal Council, the states of the EU and EEA ensure an adequate level of data protection. For the USA, this applies to companies certified under the Swiss-U.S. Data Privacy Framework. Where a recipient is not certified, we rely on the standard contractual clauses of the European Commission in the version recognised by the Federal Data Protection and Information Commissioner (FDPIC/EDÖB) (Art. 16(2)(d) DSG).
14. Retention period
We retain personal data only for as long as necessary for the purposes stated or as we are legally obliged to. In detail:
- we retain order, invoice and payment data for ten years (Art. 958f of the Swiss Code of Obligations, OR); the remaining order data for as long as it is needed to process the order, handle complaints and answer queries;
- we delete print and PDF files stored in our system two months after they were created; we retain the internal order notification (section 7.1) like the remaining order data;
- recordings of visits (session replay) are deleted after 30 days;
- your e-mail address on the newsletter or customer mailing list until you unsubscribe or object;
- enquiries via the contact form or by e-mail until your request has been dealt with, unless there is a legal obligation to retain them.
15. Your rights
Within the scope of applicable data protection law, you have in particular the right:
- to request information as to whether and which personal data we process about you (Art. 25 DSG);
- to have incorrect personal data corrected;
- to request the deletion of your personal data and to object to processing;
- to receive personal data that you have provided to us in a common electronic format or to have it transferred to another controller (Art. 28 DSG);
- to withdraw any consent given at any time.
Please send your request to hallo@dream-plan-teach.ch. We may ask for proof of your identity. Information is generally provided free of charge within 30 days; if we cannot meet this deadline, we will tell you by when you will receive the information. We may restrict or refuse your request where the law permits, e.g. if legal retention obligations prevent deletion (Art. 26 DSG).
You also have the right to lodge a complaint with the competent supervisory authority. In Switzerland, this is the Federal Data Protection and Information Commissioner (FDPIC/EDÖB), Feldeggweg 1, 3003 Bern (www.edoeb.admin.ch). Where the GDPR applies, you can also contact a supervisory authority in the EU or EEA.
16. No automated individual decisions
We do not make decisions based solely on automated processing that have legal consequences for you or significantly affect you (Art. 21 DSG).
17. Links to third-party websites
Our website contains links to third-party websites, e.g. to our Instagram profile. No data is transmitted to these providers when you visit our website. Only when you follow a link does the respective provider receive data about your visit and process it in accordance with its own privacy policy.
18. Changes to this privacy policy
We may amend this privacy policy at any time. The version published on this website at the time applies.
